Darrell Hair to Sue PCB & ICC

The Darrell Hair saga continues, with the recent announcement by Darrell Hair to take ICC and the PCB to court for “for alleged racial discrimination”. A truly brilliant argument and typical of a lawyer to twist the argument to ones own favor.
Since the Oval incident last year where Darrell Hair accuse Pakistan of ball tampering, I have been repeatedly blogged about the controversial topic and have pleaded with PCB to take Darrell Hair to court. Even Imran Khan made a very open statement suggesting the same and I quote “Unless Darrell Hair can supply concrete proof of ball-tampering, then I think the Pakistan management should seriously consider suing him”
With Hair filing the suit it puts PCB on a defensive back foot as it now has to defend its position contrary to what could have been had if PCB filed the suit according to its own stance on the issue. To prove racial discrimination is a tough task which generally is taken if a number of witnesses testify convincingly that there was a strong discrimination. As far as Hair is concerned he started the entire mess which consequentially lead him down this path, ICC in its hearing did not find credible evidence to support his ball tampering claim so hence he was definitely wrong to even suggest a side to have cheated.
One must remember that Darrell Hair himself is a lawyer so he must have this case planed with excruciating detail. My only concern is that one logical place where he might get hordes of racial bias documented statements only from the ICC meeting in Delhi which was held a few months back. During the meeting the majority of test playing nations voted to oust Hair from the elite panel. One can only assume that during the meeting some convincing argument must have been used by the Asian sides to drive their case to its finale and the word of racial discrimination most likely would have come into the minutes of the meeting in one form or the other. Hence PCB and ICC might stand to take some serious blows on that count to maybe lead to a favorable decision for Darrell Hair.
Technically that probably is the only argument that can be used to support his case, if not, then he might be walking the fine line and PCB should definitely plan to file a counter suit. It simply going to become a dirty brawl which could potentially hurt Darrell Hair more then Pakistan, ICC on the other played a slick move a few days earlier by not expelling Hair from umpiring but reappointed him to adjudicate a series of matches of the Little league at least they can say they did not expel him but simply reappointed him to another position.
Whatever the outcome it is undoubtedly another feather on the dunce cap of Naseem Ashraf to add this to his growing list of bloopers. We at Cricket Bloggers of Pakistan should start a page listing his ongoing bloopers, its bound to get interesting with time, though it already is….

Whether or not Pakistan tampered with the ball is irrelevant to this case.
The only relevant issue is whether Hair was demoted, sacked or otherwise disadvantaged on the basis of race. If it is true, as you suggest, that “the word of racial discrimination most likely would have come into the minutes of the meeting in one form or the other.”, then the ICC is indeed in deep trouble.
Remember also, that the ECB, NZCB, and ACB voted against punishing him. It is likely that Hair has received some “inside” information about the proceedings, which he can use in his case.
If he was racially discriminated against, I hope the tribunal throws the book at the ICC and anyone else involved. Racism in all its forms is disgusting and should be condemned by all.
